CARGA FISCAL III - TRIBUTUM ONERIBUS III - FISCAL BURDEN III

Portugal had years of fiscal relax, after the formal integration in European Economic Community (EEC) in 1996, after another International Monetary Funf (IMF) between 1983 and 1985, with favorable winds and under the opportunistic government leaded by the fiscalist along ten years, the principal responsable: named Aníbal Cavaco Silva (PSD), actual President of Republic, created structural and not sustentable public expenses with absolute majority in Parliament, a problem without a begining to implement solutions under Troika intervention!

After in a Government leaded by Socialist Party, but with a strong influence of a former member of Communist Party with the control of Economy and Finances, named Pina de Moura, was created a statal monster named «Lei Geral Tributária» («General Fiscal Law») in the end of 1998, with 34 versions until the end of 2013: the fall of the high fiscal relax and the rise of the high fiscal stress, as usual in Portugal a high level of political bipolarity over Families and Companies, over the Creation of Value!

The concept (to much power gave to fiscal authority with inversion of the onus of prof) and the praxis of the Law are a disaster: with the leading of a person belonging to bank, Paulo Macedo, paid with a lot of money from General Government Budget (350.000 € / year), from taxes and debt between 2004 and 2007, was implemented a monstruous system with banking «best pratics» that created an horrible linkage between State and Banks with a high level of penalties (a fiscal execution system):
- bank accounts integral blocked (like a car in a city) with a «debt» (many times without support of real revenues for taxation) lower than the total of positive balance;
- other blinded pratics of pawn always by informatic systems in colision with the rights of Families and Companies
- State turned a stakeholder much more no enabler of solving process than banks in the worst scenario of crisis!

If a Family, a Person, a Company request the right of pay a debt by installments because don´t have capacity to pay all in the moment, State request a bank guaranty that many times Families, Persons or Companies can´t have!!!

About this kind of fiscal "tyranny" the Constitutional Court and the Parliament don´t do nothing ... Families and Companies can´t use a slow and expensive justice against State that in the mean time have the money or other assets in the bad side!

This situation must change soon as possible, as a vicioous circle, an incredible driver of impoverishment and value destruction!
